Terms and Conditions Included in Liability Waiver

By signing up for a Big Round World trip, you agree to be bound by the following terms:

Responsibility: Big Round World’s responsibility is limited. Big Round World organizes, promotes, and sells tour programs consisting of certain travel services, including land, air, and water transportation, excursions, and cruise/barge/hotel accommodations and food that Big Round World purchases or reserves from various suppliers (collectively, “Suppliers”). Big Round World neither owns nor operates any of these Suppliers; they are independent contractors and are not Big Round World’s agents. Big Round World is not responsible for, and will not be liable for, any act, omission, negligence, fault, or breach of contract of any Supplier, or for any injury, death, damage, loss, accident, delay, irregularity, or expense (“Injuries and Damages”) caused by any Supplier or by any event beyond Big Round World’s reasonable control. You agree to look to such Suppliers, and not to Big Round World or its agents, for any Injuries and Damages you may suffer. 

Without limitation, Big Round World is not responsible for any Injuries and Damages in connection with the provision of, or failure to provide, any goods or services occasioned by or resulting from — but not limited to — acts of God or force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, mechanical or other failure of airplanes or other means of transportation, or the failure of any transportation mechanism to arrive or depart on time, or for any other cause beyond the direct control of Big Round World. Except to the extent caused by Big Round World’s gross negligence or willful misconduct (to the extent such limitation is not prohibited by applicable law), you agree to voluntarily assume all such risks and are responsible for obtaining appropriate insurance (including medical, evacuation, trip cancellation/ interruption, loss of luggage or personal effects) coverage. 

Safety & Risks: You understand that during your participation in a Big Round World Trip, you may be exposed to a variety of hazards and risks, foreseen or unforeseen, which are inherent in each Trip and cannot be eliminated without destroying the unique character of the Trip. Certain risks — from natural disasters to accidents, outbreaks of illness, crime, insect-borne and other infectious diseases, environmental risks to health, high altitude sickness, terrorism and other unforeseen events — are inherent in travel. These inherent risks include, but are not limited to, the dangers of serious personal injury, death and property damage. You confirm Big Round World has not tried to contradict or minimize your understanding of these risks. While such occurrences are beyond the control of Big Round World, Big Round World makes substantial efforts to be prepared for such possibilities. You understand your requirement to review the safety and travel information provided by the U.S. Department of State and Centers for Disease Control and Prevention (CDC) to learn about current security issues, travel advisories and warnings, recent embassy notices, local laws and customs, country-specific health information, health risks you may encounter while traveling, precautions for the prevention of illness, disease and general health issues during your tour program, and other helpful destination-specific information. By enrolling in Big Round World’s tour program, you agree to assume responsibility for your own health, safety, and welfare, and acknowledge that Big Round World cannot guarantee your safety or health at any time. 

No Liability for Certain Damages: To the maximum extent permitted by law, Big Round World will not be liable to you for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of enjoyment, loss of profits, loss of business opportunity, loss of goodwill, or emotional distress, arising out of or relating to the Services or this Agreement, whether based in contract, tort (including negligence), strict liability, warranty, statute, or otherwise, even if Big Round World has been advised of the possibility of such damages. 

Cap on Liability: To the maximum extent permitted by law, Big Round World’s total aggregate liability to you for all claims arising out of or relating to the Services or this Agreement will not exceed the lesser of (i) the total amount actually paid by you to Big Round World for the specific booking giving rise to the claim, or (ii) $10,000. Any amounts refunded by Big Round World for that booking will reduce, dollar-for-dollar, the maximum liability under this Section. 

Time Limit to Bring Claims: To the maximum extent permitted by law, you confirm you must provide written notice of any claim within thirty [30] days after the event giving rise to the claim and must file any lawsuit or proceeding within one (1) year after the event giving rise to the claim, or the claim is permanently barred. 

Big Round World reserves the right to make reasonable changes to the itinerary where deemed necessary or reasonable for the comfort and safety of trip members. Big Round World reserves the right to decline to accept or retain you as a trip participant should your physical ability to complete the trip, behavior, health or mental condition impede the operation of the trip as determined by the Trip Leader. Trip Leaders have the right to disqualify you at any time during the trip if they feel you are incapable of continuing and/or if your continued participation jeopardizes the group's or your own safety and or enjoyment of the trip. Under these circumstances, refunds are not given. 

Modifications to Terms and Conditions: Big Round World reserves the right at any time to update, change, modify, or revise these Terms and Conditions at any time. Any changes will become effective upon posting the changes, modifications or revisions to the Terms and Conditions. Accordingly, you should review Big Round World’s Terms and Conditions regularly prior to travel in order to ensure you are aware of any changes. 

Applicable Law: Big Round World LLC is a company registered in the State of Colorado. As such this Agreement shall be governed by the laws of the State of Colorado, USA. Any claims against Big Round World must be brought in the Court of Boulder County to the exclusion of the Courts of any other state and country.

The Liability Waiver further includes the following statement:

I have read any rules and conditions applicable to the Trip made available to me; I will pay any costs and fees for the Trip; and I acknowledge my participation is at the discretion of the Trip Leader.

The Trip officially begins and ends at the location(s) designated by Big Round World. The Trip does not include carpooling, transportation, or transit to and from the Trip, and I am personally responsible for all risks and costs associated with this travel. If I decide to leave early and not to complete the Trip as planned, I assume all risks and costs inherent in my decision to leave and waive all liability against Big Round World arising from that decision. Likewise, if the Trip Leader has concluded the Trip, and I decide to go forward without the Trip Leader, I assume all risks and costs inherent in my decision to go forward and waive all liability against Big Round World arising from that decision. 

This Agreement is intended to be as broad and inclusive as is permitted by law. If any provision or any part of any provision of this Agreement is held to be invalid or legally unenforceable for any reason, the remainder of this Agreement shall not be affected thereby and shall remain valid and fully enforceable. 

To the fullest extent allowed by law, I agree to WAIVE, DISCHARGE CLAIMS, AND RELEASE FROM LIABILITY Big Round World and their respective employees, agents, representatives, trip leaders, local guides and assigns from any and all liability on account of, or in any way resulting from Injuries and Damages, even if caused by negligence of Big Round World and their respective employees, agents, representatives, trip leaders, local guides and assigns, in any way connected with this Trip. I further agree to HOLD HARMLESS Big Round World and their respective employees, agents, representatives, trip leaders, local guides and assigns from any claims, damages, injuries or losses caused by my own negligence while a participant on the Trip. I understand and intend that this assumption of risk and release is binding upon my heirs, executors, administrators and assigns, and includes any minors accompanying me on the Trip. 

Publicity Permission (Optional): Big Round World staff or others sometimes capture photographs, quotes, or other impressions or recordings of participants and share them with Big Round World for use in a variety of ways, such as (but not limited to) in trip brochures, web pages, or social media of Big Round World. You have the option to agree to or deny publicity permission.

Medical Authorization and Coverage 

In the event you become sufficiently incapacitated as to be unable to direct your own care, there is no one on the tour who can direct your care, and Big Round World is unable to contact your emergency contact(s), you confirm, by registering and paying a deposit for a tour, you authorize the provision of emergency medical treatment in the event of any injury or illness while participating in the tour including, but not limited to, X-ray, examination, anesthetic, medical or surgical diagnosis, or treatment and hospital care, as deemed necessary by a licensed attending physician. In addition, you certify that you have medical insurance which will cover personal accidents, medical expenses, loss of effects, and all other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to you, and that in the absence of this medical insurance coverage, or for costs not covered by this medical insurance coverage, you agree to pay all costs of rescue and/or medical services as may be incurred on your behalf.
